Welcome to Art Escape (the “Site”) at https://art-escape.com.au/ and our studio in Dayboro (“Studio”). These Terms of Use (“Terms”) govern your use of our Site, Studio, social channels, and any products or services we provide (collectively, the “Services”). By using our Site or booking/attending an event (“Event”), you agree to these Terms and our
Privacy Policy and Conditions of Entry.

1) Consent to Site & Event Terms
By accessing our Site, Studio, social channels, or materials we provide (paid or free), you warrant that you:
are over 18 and legally able to enter a binding contract;
have read, understood, and accept these Terms; and
will comply with these Terms.
If you do not accept these Terms, please do not use our Site or book our Events.
2) Changes to These Terms
We may update the Site and these Terms at any time. Changes take effect when posted on the Site. Your continued use means you accept the updated Terms.
3) Event Details & Registration
Event details and ticket prices (“Event Fees”) are listed on our Site, including whether an Event is family-friendly or suitable for under-18s. Bookings are first-come, first-served and confirmed on payment.
You agree to provide accurate, current information and keep it updated. We may refuse participation if information appears inaccurate.
Under-18 events (QLD): rostered team members will hold a valid Working with Children Check (Blue Card) or state equivalent.
4) Booking Confirmation
Once you purchase tickets, you’ll receive an email confirming the date, time, ticket quantity and total paid. This confirmation evidences your agreement to these Terms and our Privacy Policy.
5) What’s Included
Unless stated otherwise, Event Fees admit one (1) person to the specified Event and include use of the materials listed on the Event page.
We do not provide child-minding. A parent/guardian must supervise their children for the duration of any family or under-18 session.
We are not responsible for your additional costs (e.g., travel, meals, accommodation) unless expressly included in the Event listing.
6) Privacy
Your use of our Site and Services is also governed by our Privacy Policy (see Site). By using the Site/Services, you consent to the collection and use of your information as described there and warrant your data is accurate.
7) Accounts
Some features may require an account. Provide accurate details (name, address, valid email, phone) and keep your password secure. You’re responsible for all activity on your account. We may suspend or cancel accounts for breaches of these Terms or applicable law.
8) Intellectual Property
We (and our licensors) own all intellectual property in our Site, Studio content, artworks, curriculum, designs, logos, text, images, audio/video, guides, templates and software (“Content”). Your access does not grant you ownership or any right to use our Content beyond what these Terms allow.
No Commercial Use
You must not copy, adapt, reproduce, publish, sell, distribute, perform, display, create derivative works from, or exploit our Site, Services, Content or third-party licensed content without our prior written consent. We may suspend access without refund if you breach this clause.
Limited Licence — Digital Products
If you purchase or download digital items (e.g., checklists, guides, workbooks, videos, audio), you receive a non-exclusive, non-transferable licence for personal use only. You may not share, resell, upload, or transfer them without our written consent.
9) Prices & Payment
All prices are in AUD and include GST (where applicable). Prices may change without notice. The price at checkout is the price payable.
A small booking/processing fee may apply per transaction and will be shown at checkout. This fee is non-refundable (including on cancellations, refunds or reschedules), except where required by law.
Online payments: Visa, MasterCard, American Express, PayPal, and/or other methods shown at checkout.
In-studio payments: card and other methods as advised in-studio.
By paying by card, you confirm you’re authorised to use it and authorise us to charge it for all balances due. If payment fails, we may revoke access or refuse entry.
Discount codes: one code per order; cannot be combined with other offers; subject to code-specific terms.
10) Gift Cards
Valid for 3 years from issue date (per Australian law).
Delivered via email; redeemable online or in-studio as specified at purchase.
Not redeemable for cash; cannot be used for booking/processing fees unless we state otherwise.
Non-refundable except as required by law.
If a session purchased with a gift card is cancelled by us, value will be re-credited to a gift card.

11) Cancellations & Reschedules
If Art Escape Cancels/Postpones
We may postpone or cancel an Event. If we cancel a public (ticketed) Event, we’ll notify you (email/SMS) and offer:
transfer to another upcoming session, or
a credit for future use, or
a refund of the ticket price (booking/processing fees are non-refundable unless required by law).
If a Force Majeure event (e.g., government-mandated closure, severe weather, power outage) requires changes, we aren’t liable for resulting loss. We’ll act reasonably to provide a transfer or credit.
If You Need to Cancel/Reschedule — Public (Ticketed) Events
7+ days before the Event: one free reschedule or credit.
48 hours to 7 days before: reschedule/credit permitted; a rebooking fee of $25 will apply.
Under 48 hours before: your ticket is non-refundable (no reschedules/credits). But you are able to transfer your ticket to another person, provided you notify us of the name change.
No-shows: full fee is forfeited.
Add-ons (e.g., catering/grazing boards): not cancellable within 48 hours; the add-on cost will be forfeited if you cancel/reschedule in that window.
Private Events (Parties/Corporate/Exclusive Hire)
Deposits are non-refundable.
If paid in full and you request a date change more than 14 days prior, we’ll try to accommodate a new date/time that suits both parties (subject to availability; fees may apply).
Within 14 days of the booking date: fees are non-refundable and date changes aren’t guaranteed.

12) Refunds & Exchanges
Event Fees: non-refundable except as outlined above or required by law.
Digital Products: due to their nature, all sales are final. If you receive the wrong item or a broken link, we’ll provide the correct item or a working link at no extra cost.
Retail/Take-home Kits (if applicable): contact [email protected] for authorisation before returning. Approved returns must be unused and in saleable condition (unless faulty). Postage is at your cost unless required by law.
Nothing in these Terms limits your statutory rights under the Australian Consumer Law.
13) Information & Advice
Content on our Site and in Events is general information only and not professional advice (legal, medical, financial or otherwise). We may refuse service (with a refund where required) if we reasonably believe an Event or product may be unsafe or unsuitable for you.
References to third-party products/services do not imply endorsement.
14) Submitting Content (Reviews, Socials, Feedback)
We love feedback! If you submit reviews, images, or comments, you warrant you own (or are licensed to use) that content; you grant us permission to use it for marketing; and you waive moral rights to the extent permitted by law. We may remove content that is unlawful, abusive, obscene, reveals personal information, targets individuals, or is irrelevant.
Testimonials may reflect individual experiences and are not guarantees of results.
15) Links to Other Websites
Third-party links may appear on our Site or socials. We don’t control or endorse third-party content. Review their terms and privacy policies before use.
16) Prohibited Use (Site)
You must not use the Site to:
break the law or solicit unlawful acts;
infringe others’ rights;
hack, alter, deface, or disrupt the Site;
transmit malware or spam; or
impair Site performance or access.
Prohibited conduct at Events: see Conditions of Entry.
17) Warranties & Disclaimers
Accessing our Site or attending Events is at your own risk. To the fullest extent permitted by law, the Site and Services are provided “as is” and “as available” without warranties of fitness, completeness, reliability, security, or uninterrupted access.
We are not responsible for third-party content (including sponsors/partners), postponements or lineup changes due to unforeseen circumstances, or losses arising from Site outages, inaccuracies, or delays, except to the extent required by law.
18) Limitation of Liability
To the maximum extent permitted by law, we (and our officers, employees, contractors and licensors) are not liable for indirect, special or consequential loss, loss of profits, data, or opportunities arising from your use of the Site or attendance at Events. Where liability cannot be excluded, it is limited to resupplying the Services or paying the cost of resupply (Australian Consumer Law).
19) Indemnity
You agree to indemnify and hold us harmless from claims, losses, liabilities, damages and expenses (including reasonable legal costs) arising from your breach of these Terms, your unlawful conduct, or your infringement of third-party rights.
20) Additional Terms
From time to time we may offer promotions, discounts or one-to-one services governed by additional terms. If there’s a conflict, the additional terms take precedence for that offer/service.
21) Breach & Termination
We may terminate or suspend your access (and refuse future access) if you breach these Terms. Disclaimers and limitations of liability survive termination.
We may discontinue any part of the Site or Services at any time. We’re not liable for resulting loss.
22) Complaints & Non-Disparagement

your name
the email used to book
details of your concern and preferred resolution
any supporting material
We’ll acknowledge within 5 business days and aim to resolve within 14 business days.
Both parties agree not to publicly disparage the other (e.g., social media, review platforms). Concerns should be raised directly per the process above.
23) Severability
If any provision is unlawful or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions continue in full force.
24) Assignment
We may assign or subcontract our rights/obligations at any time. You may not assign your rights/obligations without our written consent.
25) Entire Agreement
These Terms (with our Privacy Policy, Conditions of Entry, and any applicable Additional Terms) form the entire agreement between you and Art Escape regarding the Site and Events.
26) Electronic Communications & Signatures
You agree to receive communications electronically and that clicking “I agree/accept/buy/book” or similar constitutes your electronic signature and binds you to these Terms.
27) Governing Law & Jurisdiction
These Terms are governed by the laws of Queensland, Australia. We’ll first attempt to resolve disputes in good faith. If unresolved, you submit to the exclusive jurisdiction of the courts of Queensland.
